Terms of Service

These terms are a working draft for early access. They will be revised before general availability. If anything here conflicts with a signed agreement, that agreement controls.

1. Acceptance

By accessing or using Opentrace ("Service"), you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Early access

During waitlist and invite-only periods, features may change, break, or be withdrawn without notice. Availability is not guaranteed. We may revoke access for misuse, security risk, or operational reasons.

3. Accounts

You are responsible for credentials issued to you, including access codes, and for activity under your account. Notify us promptly if you suspect unauthorized use.

4. Acceptable use

You may use Opentrace only for lawful purposes and in compliance with applicable laws, including privacy, surveillance, and data-protection rules in your jurisdiction. You must not use the Service to harass, stalk, discriminate, commit fraud, violate others' rights, or circumvent security controls. You must not attempt to reverse engineer, overload, or disrupt the Service except as allowed by law.

5. Open-source intelligence

Opentrace helps analyze open-source and user-provided signals. You are solely responsible for how you collect, process, and act on information. Outputs may be incomplete, incorrect, or outdated. Do not treat results as legal advice, definitive identity proof, or a substitute for independent verification.

6. Your content

You retain rights to content you submit. You grant Opentrace a limited license to host, process, and display that content as needed to operate the Service. You represent that you have the rights needed to submit that content.

7. Intellectual property

The Service, including software, branding, and documentation, is owned by Opentrace and its licensors. These Terms do not transfer ownership of any intellectual property.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

To the maximum extent permitted by law, Opentrace and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service.

10. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance.
